The Uber or Lyft insurance policies may provide up to $1 million in coverage for injuries and property damages in a majority of accident claims. Coverage Amounts for Other Motorists in Accidents with Rideshare Drivers
The determination of coverage with the rideshare company’s insurance policy will vary depending on their app. One primary factor for Uber and Lyft is whether the driver’s app is on or off. If the motorist has not turned on the rideshare app, the driver’s private insurance policy will cover the accident.
If there are more damages than the rideshare insurance policy will provide coverage for, the driver’s private insurance policy will also cover the additional damages. The state follows the contributory negligence rule, which will often complicate the settlement process. If the rideshare driver or their insurance company asserts and proves that the plaintiff shares partial liability, they will not be eligible to recover compensation for damages in this state.
If the Driver has Not Accepted the Ride
