Confidential Premises Security Settlement

We held a major national retailer accountable for failing to provide a safe environment for our client. Even when they are in public, customers should have a reasonable expectation of security, and if a property owner fails to provide that security, they can be considered negligent. While changing in a dressing room our client was sexually assaulted by a patron who previously had two other instances of sexual misconduct at that same retail location. The retail store knew about this individual but failed to follow their internal procedures on investigating and reporting the previous incidents; they also failed to take preventable measures from these acts happening again. This was a preventable situation—one that could have been avoided had proper safety measures been followed. After aggressively pursuing the case, we reached a confidential resolution. While we cannot share the terms, the message is clear: ignoring safety comes with consequences.
